WHY DO WE NEED YOUR EXPLICIT CONSENT TO USE THEM?

Judgment of the Grand Chamber of the Court of Justice of the European Union, of October 1, 2019, and Guide on the use of cookies of the AEPD, July 2020.

The judgment of the Grand Chamber of the Court of Justice of the European Union, of 1 October 2019, must be interpreted as meaning that consent is not validly given when the storage of information, or access to information already stored on the user's terminal equipment of an internet website, through cookies is authorised by means of a box marked by default from which the user has to remove the mark in case she or he wants to refuse its use. In this sense, authorisation must be based on explicit consent by means of a Check of explicit acceptance, a check of refusal by the user, and a check of more information on the cookies exposed.

This interpretation cannot vary depending on whether the information stored or consulted on the user's terminal of an Internet site consists of personal data.

The Grand Chamber of the Court of Justice of the European Union also provides in this judgment that the information that the service provider must inform to the user of an internet website the length of time that the cookies will remain active and the possibility that third parties can access the information stored in them. This requirement is established by the version amended by Directive 2009/136, which amends Article 5, paragraph 3, of Directive 2002/58/EU, and by the AEPD Guide of July 2020.
